You are not asking the court to approve anything — only to make the agency act. It works best once your case is past the agency's own posted processing time and you have already tried the administrative channels.

Verify each name the week you file. Sue officials in their official capacity. Use "Add defendant" for any agency — this is not USCIS-specific.
